The user warrants not to use the content of this website for diffamatory uses.

Milestone Media cannot be held responsible any mistakes, omissions, imprecisions in the content of the photographic features (texts, cataloguing, captioning, copyright), but will take the utmost care in checking their accuracy.

Milestone Media has the faculty of changing, modifying, updating at any time the contents of the website and of the service without prior consent of the users.

Milestone Media will not be held responsible for any of the consequences following the usage the user will make of the images, information or data obtained through the service. In consideration of the electronic nature of the on-line service, temporary interruptions due to maintenance or technical work on servers are likely to occurr. Milestone Media will take no responsibility in case of interruptions or malfunctioning of the service.

LICENSING CONDITIONS FOR RIGHTS-MANAGED IMAGES
1. All the images on www.milestonemedia.it website can be used to create comps and presentations for internal use only. You are authorised to create one single copy of the image you have chosen on hard disk for a single computer not connected to a network. It is forbidden to save the image on moveable memories (such as floppy disks, CD, DVD, zip or jaz). After usage, clients must delete the layout or the presentation from their hard disk.
2. Before deciding on any usage, please check the availability of a specific image. Milestone Media does not guarantee that all the images can be used for any trade because images are sometimes licensed exclusively for specific uses.
3. Images are not licensed exclusively unless this has been specifically agreed. Milestone Media does not license its images unlimitedly.
4. The cost of an image varies according to its usage, distribution, duration of the ad, number of copies, name and trade of the final user. In order to get a quote promptly, clients should make this information available. In case of digital images, size and resolution of the file should be specified together with the code of the requested image.
5. The high-res files can be downloaded from our website after faxing back the purchase confirmation form (filled out and signed).
6. Sending back the confirmation form implies the usage of the image at the agreed fee for the license and an invoice will be immediately issued accordingy. In case the image has not been used, the client will have to confirm this in writing:
- In case this confirmation will reach us 3 (three) days from the confirmation, Milestone Media will issue an invoice for technical costs only (amount: 50 Euros).
- In case this confirmation will reach us 8 (eight) days from the confirmation, Milestone Media will issue an invoice for 30% of the agreed fee.
- In case this confirmation will reach us 30 (thirty) days from the purchase confirmation, Milestone Media will issue an invoice for 50% of the agreed fee.
- In case this confirmation will reach us after the 30th day from the confirmation, the client will have to pay the full amount for the rights.
7. Milestone Media and the photographer do not hold the rights to what is portrayed (people, trademarks, locations, monuments etc.) unless this is specifically stated. In any case, Milestone Media will not be liable for a sum higher than the one stated in the invoice issued for the usage of the images.
8. Licensing of usage rights to a third party is forbidden unless otherwise stated in writing. The client is allowed to use the images only according to the agreed terms and under no circumstances, are other uses authorized without the consent of Milestone Media.
9. Milestone Media supplies captions, but denies any responsibility for them.
10. Editorial and on-line uses of images must carry the name of the photographer followed by Milestone Media.
11. Reproduction rights are not authorized until the corresponding invoice has been fully paid. Such payment has to take place within the agreed time limit. Delay in payment will never be admitted by Milestone Media who will then invoice the average bank interest rate accordingly.
12. In the case full payment is not made under the agreed terms, this will imply immediate cancellation of the rights and usage will be considered unauthorized.
13. Licensing of reproduction rights and its distribution does not imply the sale of the ownership of the material by the client. Digital images must be deleted after usage.
14. The customer must send at least one copy of the final usage to Milestone Media.
15. Any change to this above conditions must be agreed upon in writing by Milestone Media.
16. Any controversy will be dealt with by the Milan Court.

PROTECTION OF PERSONAL DATA AND INFORMATION 
PURSUANT TO LEGISLATIVE DECREE no. 196 of June 30th, 2003

Legislative decree no. 196 of June 30, 2003, namely "Code on the protection of personal information  and data" (hereinafter referred to as the "Law"), aims at ensuring that treatment of personal information and data (hereinafter referred to as "Data") be carried out in compliance with fundamental rights and freedoms, as well as people's dignity, with specific reference to the right to privacy and confidentiality, personal identity and protection of personal data and information.
Pursuant to article 13 of the Law we wish to inform You of the following:

1- Aims of data collection and treatment
The data you provide will be collected using electronic means and processed, also with the aid of electronic devices, for the following aims:
a) aims associated with the execution of the service requested and the administration of product purchase orders;
b) statistical aims, distribution of promotional material and information, also through the use of email;
c) aims associated with the registration on www.milestonemedia.it website.

The Data and information provided by You belong to the group of ordinary data and are different from the sensitive data for the treatment of which the lawmaker sets specific conditions, as is the case with judicial data. Indeed sensitive data and information regard racial or ethnic origins; religious, philosophical or other kinds of beliefs; political opinions; membership of parties, trade unions, religious, philosophical, political or trade union associations or organizations; health conditions; sexual habits (article 4, paragraph 1, sub-paragraph d, of the Law).

2 - Ways to collect and treat Data
Data will be treated in such a way as to ensure security and confidentiality. Data and information can be treated through manual, computerized or telematic tools, which are suitable to treat them in compliance with the security rules envisaged by the Law and/or internal rules and regulations. Data and information will be kept for a lapse of time not exceeding the time needed to reach the goals for which they were collected and subsequently treated as provided for by law.

3 - Nature of data provision and consequences entailed by any possible refusal to provide data
The provision of Data is not compulsory. However, failure to provide data in order to fill in the so-called "mandatory parts" makes it impossible to perform the services requested.

4 - Scope of disclosure and dissemination
Data and information are strictly confidential and hence they cannot be disclosed and disseminated.
Data can be disclosed to individuals, companies, professionals or law firms that provide services or assistance to Milestone Media Srl.

5 - Responsibility
Milestone Media Srl - located in Milan, via A. Wildt 19/5) - is responsible for data treatment and can be addressed to exercise the rights envisaged by article 7 of the Law, which is hereafter fully quoted:

Article 7 of the legislative decree 196/2003 - right of access to personal data and other rights
1. The person concerned has the right to obtain confirmation of the existence of personal data and information regarding him/her - even though not recorded yet - and their disclosure under an intelligible form.

2. The person concerned is entitled to be informed of:
a) the origin of personal data and information;
b) data treatment purposes and ways;
c) the logic followed in the event of data treatment being carried out with electronic tools;
d) the details to identify the owner, the persons in charge and the representative appointed under article 5, paragraph 2;
e) the people or groups of people to whom personal data and information can be disclosed or who may come to know them in their capacity as representative appointed in the State territory or persons in charge.

3. The person concerned has the right to obtain:
a) updating, correction or - where interested in this process - supplementation of data;
b) ancellation, turning into anonymous data or the block of data treated by infringing the law, including data and information which need not be kept in relation to the purposes for which data and information were collected or subsequently treated;
c) a certificate stating that the operations under sub-paragraphs a) and b) - including their content - have been communicated to those to whom data and information were provided or disclosed, except the case when this proves to be impossible or entails the use of such an amount of means which is overtly non commensurate with the right which is protected.

4. The person concerned has to right to wholly or partially refuse:
a) treatment of personal data and information regarding him/her for legitimate reasons, even though they are relevant to the aim of collection;
b) treatment of personal data regarding him/her for the purposes of sending advertising material, direct sale or performance of market studies or commercial communications.

Submission of data is voluntary, but any refusal to provide it makes it impossible to register on www.milestonemedia.it website.
